Poor Vendor Performance

The Non-Performing Vendor

Situation

Our client, one of the 50 largest insurance companies in the U.S., had contracted with a software vendor for the delivery of a large and complex software package that had not yet been completed. It was to be delivered in pieces ("releases") on a pre determined schedule. The vendor was not meeting the schedule, and the project at the insurance company was in disarray. Although the insurance company VP was preparing to sue the vendor, he asked that we try to remediate the conflict.

Actions Taken

We reviewed the history of the project, the contracts involved, and met with the project staff and with the Executive Vice President of the vendor. The SMR consultant suspected that our client was strategically very important to the vendor's marketing plan, and suggested to our client that we renegotiate the contracts.

Results Obtained

The software and services contracts were restructured, incorporating realistic delivery dates and quality guidelines. The SMR consultant obtained monetary concessions for out client over 10 times as large as our total fees. The project was stabilized and went to completion. Our client became a development partner with the vendor, substantially improving the vendor's software sales. A classic Win-Win solution with which we were very pleased.
